Terms of Use

1. Acceptance of Terms

Welcome to the Uplift Nigeria platform. The services are provided by ULN Together Technologies LTD. These Terms of Use govern your access and use of our website, applications, and services. By accessing, browsing, or using our platform, you confirm that you have read, understood, and agree to be legally bound by these terms. If you do not agree, you are not permitted to use our services.

2. Purpose of the Platform

The Uplift Nigeria platform is a technology-enabled service that connects donors with verified beneficiaries for charitable purposes in Nigeria. Our role is to facilitate the connection and process transactions. We are not a party to the direct agreement between a donor and a beneficiary.

3. Eligibility and Account

Beneficiary Eligibility:

Beneficiaries must be Nigerian citizens residing in Nigeria.

Donor Eligibility:

Donors can be individuals or corporations, both local (residing in Nigeria) and foreign. All individual users, regardless of location, must be at least 18 years of age.

Account Creation:

To access certain services, you must register and create an account. You're responsible for keeping your account credentials (user ID and password) confidential and secure. You must provide accurate and complete information during registration and keep it updated. We reserve the right to refuse or cancel any account at our sole discretion.

4. Donations and Financial Transactions

Donation Mechanism:

Donations are made through our integrated payment partners. By making a donation, you authorize ULN Together Technologies and our payment partners to process the transaction and disburse the funds to the intended beneficiary.

Foreign Donations:

Foreign donors may be subject to additional verification procedures and transaction fees imposed by their financial institutions or international payment processors. Donors are responsible for any currency conversion fees, foreign transaction fees, or other charges related to their donation.

Platform Fees:

To support our operational costs, a small, transparent fee may be deducted from the donation amount before it's disbursed to the beneficiary. This fee will be clearly stated at the time of donation.

Non-Refundable:

All donations made through the platform are non-refundable.

Donor Responsibility:

Donors are responsible for the accuracy of their donation details. We are not liable for any loss arising from incorrect information provided by a donor.

5. User Conduct and Prohibited Activities

You agree to use our platform only for its intended charitable purpose and in a lawful manner. The following activities are strictly prohibited:

  • Misusing funds or providing false, inaccurate, or misleading information during registration or donation.
  • Engaging in fraudulent, illegal, or unauthorized campaigns, including money laundering or financing terrorism.
  • Impersonating any person or entity.
  • Using stolen credit cards or other fraudulent means of payment.
  • Uploading malicious software, viruses, or any material that is technologically harmful.
  • Attempting to gain unauthorized access to our platform, servers, or any related database.

6. Content and Communication

Public Content:

Any information, photos, or content you submit to public parts of the platform (e.g., fundraiser pages, comments) may be visible to anyone, including public visitors. We are not responsible for the privacy of any information that you choose to make public.

Monitoring:

We reserve the right, but have no obligation, to review or remove any user-submitted content that we, in our sole discretion, deem inappropriate, misleading, or in violation of these Terms.

7. Warranties and Limitation of Liability

No Warranty:

We provide no warranty as to the use or suitability of any donations given to beneficiaries. We dont guarantee that donations will be used for the exact purposes stated, as circumstances may change for beneficiaries.

Limitation of Liability:

ULN Together Technologies and its affiliates, officers, directors, or employees will not be liable for any loss, damage, expense, or delay incurred by a user arising from or in connection with the actions or omissions of a beneficiary or any third party. We are not responsible for any indirect or consequential losses, including loss of profits or business.

Disclaimer:

We'll use reasonable care and skill to ensure the platform is secure. However, we are not liable for any loss or damage caused by a denial-of-service attack, virus, or other technologically harmful material that may infect your computer equipment due to your use of our platform.

8. Indemnification

You agree to indemnify and hold harmless ULN Together Technologies and its affiliates, officers, and employees from any losses, damages, costs, or legal fees that result from your violation of these Terms or any activity related to your account, including negligent or wrongful conduct.

9. Account Suspension and Closure

You can close your account at any time. We reserve the right to suspend or terminate your access to the platform without notice if we suspect any breach of these Terms, fraud, or misuse of the platform. Upon account closure, we have no obligation to you to retain data relating to your account or donations.

10. Events Outside Our Control

We will not be liable for any failure or delay in fulfilling our obligations under these Terms that is caused by an event beyond our reasonable control. This includes, but is not limited to, strikes, civil unrest, natural disasters, and government regulations.

11. Changes to the Terms

We reserve the right to modify these Terms at any time. We'll post the updated version on our website, and it's your responsibility to review these changes. Your continued use of the platform after any changes signifies your acceptance of the updated Terms.

12. Reporting Violations

Any misuse or violation of these Terms should be reported immediately to our compliance team at compliance@upliftnigeria.com.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Nigeria. Any dispute arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of Nigeria.
